Why is it important to submit a report?

Often employees or other third parties are in a position to know about irregularities that the Company fails to identify in a timely manner.

Responsible reporting, carried out in good faith and in the interest of the common good, can enable the Company to intercept in good time and remedy illegitimate behaviour such as corruption, fraud, money laundering, etc., which represent violations of the Code of Conduct, company procedures, legal regulations, and/or which may damage the image and financial assets of the Company.

The W3 Companies (understood as Wind Tre S.p.A., Wind Tre Italia S.p.A. and 3Lettronica S.p.A.) and Wind Tre Retail S.r.l. have, therefore, drawn up a whistleblowing policy (available on this platform in the FAQs) in order to:

• represent the whistleblowing process for W3 Companies and Wind Tre Retail, also in compliance with the regulatory provisions of Legislative Decree no. 24/2023 on the protection of persons who report breaches of European Union law and national law

• promote a corporate culture that combats illegality, through the active and responsible participation of all employees and, more generally, of all those who collaborate with W3 Companies and Wind Tre Retail.

What can be reported?

As specified in the Whistleblowing Policy of the W3 Companies (understood as Wind Tre S.p.A., 3Lettronica S.p.A. and Wind Tre Italia S.p.A.) and in the Whistleblowing Policy of Wind Tre Retail (available on this platform in the FAQs) in the paragraph "Subject of the reports", the following may be reported:

(i) unlawful conduct falling within the scope of Legislative Decree 24/2023:

• Relevant unlawful conduct pursuant to Legislative Decree no. 231/2001 or violations of the organisation and management models provided for therein

• Offences falling within the scope of EU acts
­
• Acts or omissions affecting the financial interests of the Union as referred to in Article 325 of the Treaty on the Functioning of the European Union as specified in law
­
• Acts or omissions relating to the internal market, as referred to in Article 26(2) of the Treaty on the Functioning of the European Union
­
• Acts or conduct which defeat the object or purpose of the provisions of EU acts in the areas referred to in the preceding paragraphs
­

(ii) other unlawful conduct not falling within the scope of Legislative Decree 24/2023 and to which the aforementioned Decree does not apply:

• Violation of the SA 8000 Social responsibility standard
• Fraud to the detriment of the Company
• Violation of Company Policies, Procedures, Internal Guidelines and other regulations.

For these reports, the W3 and Wind Tre Retail Companies will in any case implement all the necessary actions to protect the Reporter and the confidentiality of the information acquired during the reporting management process.

Furthermore, for the sake of completeness of information, it should be noted that:

• Reports pursuant to Legislative Decree no. 24/2023 will be managed, in line with the provisions of the aforementioned Decree, by an independent "Management Body" that differs in its composition depending on whether the report concerns the W3 or Wind Tre Retail Companies;

• Other Reports not falling within the scope of Legislative Decree no. 24/2023, will be managed by a single Reporting Committee, both for W3 Companies and for Wind Tre Retail.

How do I submit a report? What is a secured postbox and how can I use it?

To submit a report, even anonymously, you need to click on the "Send report" button at the top of the introduction page.

The reporting process is divided into the following steps:

1. Log in to the platform by entering the captcha code displayed.
2. Select the subject of your report (e.g. Relevant unlawful conduct pursuant to Legislative Decree no. 231/2001; offences that fall within the scope of European Union acts, other issues such as fraud to the detriment of the Company, violation of internal procedures, violation of the SA 8000 standard, etc.).
3. Describe in detail the incidents that are the subject of the report and answer some questions by simply selecting the answers from the drop-down menu. Please remember that it is important to make a "detailed" report: this means that the incidents or circumstances constituting the founding elements of the alleged illicit conduct (e.g. type of offence, reference period, value, companies/company areas/people involved, anomalies in the internal control system, etc.) must be clearly and thoroughly reported in order to allow the Company to verify the validity of the report. You can type up to 5000 characters in the free text field, i.e. the equivalent of an A4 page. You can also send a file of up to 50 MB to support your report. Please note that documents may contain information about the reporter.
4. Answer the question "for which company do you wish to send the report" by selecting the company using the drop-down menu. If you do not make a choice, it will not be possible to proceed with the report as all reports must be correctly addressed to the Management Body of the Company responsible for its management.
5. Once you have submitted your report, you will receive a reference number to confirm that your report has been submitted.
6. Complete the reporting process by using and confirming your own secured postbox. This is the only way for you to stay in contact with the Companies, to receive feedback on your report, or to be contacted if you need clarification or further information on the incidents reported. Please note that throughout the reporting process, the platform will guarantee total anonymity if requested.

Once you have submitted your report and confirmed your secured postbox, you can access the platform by clicking on the "Login" button, typing in the captcha code displayed on the page and entering your username and password.

How do I receive feedback and remain anonymous at the same time?

The basic principle of the BKMS^® platform used here is the protection of the whistleblower. The platform guarantees, in accordance with Legislative Decree no. 24/2023 the confidentiality of the whistleblower's identity and anonymity, where required, at all stages of the reporting process.

The system's anonymity protection function is certified by an independent body, so you will be able to dialogue through the platform anonymously.

When you use and confirm your secured postbox, you enter your username and password, which you can use to log in at any time. If you lose your login data, please send a new report and set up a new postbox. If possible, please provide the reference number of your initial report. As this is a new postbox, you will not see the content of your previous report.

Your report is kept confidential and anonymous through encryption.
Please note that the W3 Companies (understood as Wind Tre S.p.A., Wind Tre Italia S.p.A., 3Lettronica S.p.A.) and Wind Tre Retail S.r.l.:

• always protect the confidentiality of the reporter's identity, even if the reporter decides to disclose his or her identity.
• will not tolerate retaliation, threats or discriminatory acts against any person who submits a report in good faith.
